Letter to Lithgow City Council, Permission Granted, Premission Retracted

Below is the recent correspondence between AVN and Lithgow City Council requesting permission to park the Vaxxed Bus in Lithgow.

As you will see, permission was granted by the council and then retracted a week later by the releiving General Manager of Lithgow City Council, Jonathon Edgecombe.

LETTER FROM AVN TO LCC, 11 August 2022.

Subject: permission to park

To Whom it may concern,

I wish to seek permission to use parking at a public park within your Council on the 4th September, 2022. Our organisation is the Australian Vaccination risks Network Inc and we are planning to tour through your area. The Vaxxed Bus has been touring Australia for 2years now. In that time, we have collected the stories of over 400 families whose loved ones that have either been killed or injured by vaccines. We and our members find this very important work as it gives a voice to the voiceless.

Do you have a site that will accommodate the bus and, if at all possible, have a covered area for us to set up our book stall so we can sell our stock there as well?

Our bus will need to park for the day near a park to conduct interviews within the bus and have a small table nearby to great people. Our bus is 10.4m L x 3.5 H x 2.7m W.

I look forward to hearing from you.

Kind regards

Nadine Sisterson

AVN President

Good Afternoon

Thankyou for your email with relation to using a park space within the LGA for your tour.

I would recommend parking out the front of Queen Elizabeth Park on Main Street Lithgow, unfortunately we do not have a covered area to hold your book stall nearby.

With parking on the Main Street, you will require a temporary footpath trading permit to have your table etc on the footpath during the course of your planned event.

I have attached the application , which you must provide public liability insurance of $20million , a site plan of the set up of tables chairs etc with measurements.

The applicable fees are

$93.00 for the application and;

$16.80 per lineal metre for the approval ( based on the length of the bus total would be $174.72)

Total: $267.72

These fees are required upon lodgement of the application and can be paid to the customer service team by cash , cheque or credit card ( please note that there is a 0.9% surcharge on credit card transactions).

Should you have any questions or require further information, please do not hesitate to contact Council on 02 6354 9999 or via email [email protected]

RETRACTION LETTER, 31 August 2022.

Subject: RE: Permission to Park
Date: Wed, 31 Aug 2022 06:14:02 +0000
From: Jonathon Edgecombe <[email protected]>
To: ‘[email protected]’ <[email protected]>

Good afternoon Nadine,

Thank you for your emails below. I appreciate you taking the time to reach out to Lithgow Council.

At great lengths I have considered your request. I have also discussed this matter with Council’s Mayor and Deputy Mayor. For the purposes you detail below, Lithgow Council rejects your application to book any public lands under the care and control of Council.

This decision has been made with due regard to public interest. The Council has an obligation to take that action which is necessary and within its power to protect the health and safety of the public. It is considered that your booking will facilitate the dissemination of information which differs from that made public by NSW Health regarding the efficacy of vaccines. Council does not consider this to be in the broad public interest. We encourage our residents to seek balanced information on this topic, from reputable sources.

This decision has been made under authority afforded by the Local Government Act. Specifically, the Council may decline any application for approval where it is deemed that that application is not compatible with the public interest, with due respect to the protection of public health and safety. I refer to both Sections 68 and 89 of the Local Government Act 1993.

Kind regards,

Jonathon Edgecombe
